Description of Work

This position reports to the Division of Public Health (DPH) Director of Regulatory and Legal Affairs and will be part of the leadership team in the DPH Office of Regulatory and Legal Affairs (RLA) with a supervisory role. This position is a subject matter expert on all program areas related to public health law, administrative rulemaking, human subjects research law, IRB administration, and state and federal information privacy requirements. This position represents RLA in meetings and presents at educational events and conferences in furtherance of the public health mission. This position consults on regulatory and legal issues, including division-wide and state-wide application and enforcement of public health statutes and rules. This position manages requests for legal agreements received by RLA, including data use agreements (DUAs), memorandums of agreement (MOAs), and material transfer agreements (MTAs). This involves working with DPH staff and third parties to understand agreement requirements and drafting, reviewing, and negotiating agreement provisions in compliance with state and federal law, including laws on privacy and confidentiality. This position provides support to the Rulemaking Coordinator for the Commission for Public Health (CPH) and State Registrar of Vital Statistics. This position understands the administrative rulemaking process in North Carolina and is responsible for guiding DPH staff in this process and assisting the Rulemaking Coordinator in shepherding rules in a timely fashion from rule drafting to final approval by the Rules Review Commission (RRC). This position serves as the DPH Institutional Review Board (IRB) Administrator and is responsible for managing the day-to-day activities of the DPH IRB, including managing federal filings, maintaining the DPH IRB protocol and forms, facilitating DPH IRB meetings, and overseeing education and compliance.
 
This position is composed of:

25% – Leadership and Legal Consultation   
 
This position works with the Director of Regulatory and Legal Affairs to lead DPH’s Office of Regulatory and Legal Affairs (RLA) and supervises staff within RLA. This position represents RLA and DPH in state and national meetings and presents at educational events and conferences in furtherance of the public health mission. This position consults on regulatory and legal issues, including division-wide and state-wide application and enforcement of public health statutes and rules. This position also provides legal consultation to state and local public health staff on public health issues.
 
30% - Management of Legal Agreements
 
This position manages requests for legal agreements received by RLA. This includes working with DPH staff and third parties to understand agreement requirements and drafting, reviewing, and negotiating agreement provisions in compliance with state and federal law, including laws on privacy and confidentiality. Primary types of agreements include data use agreements (DUAs), memorandums of agreement (MOAs), and material transfer agreements (MTAs). This position is responsible for tracking legal agreements, developing and maintaining templates, forms, and review processes, managing internal and external stakeholder relationships, and providing updates and reports to the Director of Regulatory and Legal Affairs and other DPH leadership. 
 
30% - Support of Administrative Rulemaking and the Commission for Public Health
 
This position provides support to the Rulemaking Coordinator for the Commission for Public Health (CPH) and State Registrar of Vital Statistics. This position is responsible for understanding the administrative rulemaking process in North Carolina, guiding DPH staff in this process, and assisting the Rulemaking Coordinator in shepherding rules in a timely fashion from rule drafting to final approval by the Rules Review Commission (RRC). This includes meeting independently with DPH staff to assist in drafting and formatting rules, drafting and securing approval by the Office of State Budget Management (OSBM) of rulemaking fiscal notes, coordinating and leading rulemaking public hearings, and responding to feedback from RRC counsel. As such, this work requires great attention to detail, independence, and self-starting behavior.
 
15% - Administration of the DPH Institutional Review Board (IRB)
 
This position serves as the DPH Institutional Review Board (IRB) Administrator and is responsible for managing the DPH IRB. The DPH IRB operates under provisions of the Code of Federal Regulations, is registered with the Office for Human Research Protections (OHRP), and holds a DHHS Federal-wide Assurance (FWA). This position is responsible for updating and maintaining the federal FWA and IRB registration and the DPH IRB protocol and forms. This position facilitates DPH IRB meetings, provides relevant education and training to DPH staff and the IRB Board on IRB processes and regulatory compliance, and is responsible for all day-to-day activities of the DPH IRB. This person functions as the primary point of contact for staff performing human subject research and provides staff support to the DPH IRB. This position works closely with the Chair of the DPH IRB to ensure that agency research is conducted ethically and in accordance with law.  As such, this work requires a good deal of independent initiative.

The North Carolina Division of Public Health (DPH) is accountable for the protection, promotion, and preservation of health for North Carolinians through ethical, compassionate, and ongoing health practices. Public health is a network of essential services working and cooperating to protect and improve North Carolina’s health and to make communities safe and healthy places to live. The primary goals of the division include strengthening public health infrastructure, improving health outcomes, and eliminating health disparities. The division interfaces with 86 local health departments throughout the state which are the primary deliverers of public health programs.
 
The Office of Regulatory and Legal Affairs (RLA) sits within the DPH Division Director’s Office. The Director of RLA is part of the DPH leadership team. RLA supports administrative rulemaking by the Commission for Public Health and State Registrar of Vital Statistics, provides legal consultation to state and local public health officials on public health issues, drafts, reviews and negotiates public health legal agreements, and administers the DPH Institutional Review Board (IRB). The RLA team is responsible for public health legal and regulatory support to NCDHHS and DPH leadership and staff, including the Assistant Secretary for Public Health and the State Health Director.

Management Preferences:
  • Juris Doctor degree and license to practice law in North Carolina.
  • Knowledge of or experience with public health law, programs, and processes.  
  • Knowledge of or experience with the administrative rulemaking process in North Carolina.
  • Knowledge of or experience with state and federal privacy laws. 
  • Knowledge of or experience with human subject research law and IRB administration.

Minimum Education and Experience Requirements

Bachelor's degree from an appropriately accredited institution and five (5) years of experience in the program area of assignment, including two years of supervisory program experience

an equivalent combination of training and experience.
